Terms and conditions for 12 x 3 Personal Training Package

Client Agreement for "12 x 3 Personal Training Package"

The “12 x 3 Personal Training Package” is a commitment to fulfill three, twelve session periods. Bills will be put through after the twelfth session or after eight weeks from your previous bill (whichever comes first).


Client Eligibility Terms

• The Client must successfully complete a Par-Q.

• The Client must divulge medical histories, such as disease, illness, past injuries, current injuries, current medications, etc which pertains to their ability to partake in exercise and physical activity.

• The Client must be willing to limit unhealthy lifestyle habits such as limiting alcohol consumption, smoking, unhealthy eating, unhealthy sleep habits, etc... In order to meet their fitness and health goals, as well as fully benefit from the fitness program they are provided with.

• The Client must be willing to learn new techniques and methods of exercise.

• The Client must be willing to give their best effort during training sessions.

• The Client must be willing to follow the instruction of the personal trainer/instructor to the best of their abilities.


Failure to comply with these Client Eligibility Terms may result in the cancellation of services with the Client at any time by Proactive Training.


Conduct of Training Session Terms

• The Client agrees that if their coach can no longer fulfill their sessions they will be transferred to another proactive coach who will continue their program

• The Client must wear proper attire (i.e. shorts, sweatpants, t-shirt, tennis/running shoes, etc…) absolutely no jeans, jean shorts, sandals, open toe shoes of any kind are allowed.

• All sessions will be conducted at the location/fitness facility agreed upon by the Personal Trainer and Client.

• Training sessions will be approximately 45 minutes in length. All training sessions will be recorded in our software.

• Training sessions are for training purposes. Clients must give their full attention and focus to the training session. Distractions such as interruptions from cell phones, telephones, friends, family members, etc will not be tolerated.

• The Client must be open and honest and report to the Trainer during the session if they feel any kind of physical discomfort such as; episodes of transient lightheadedness, dizziness, abnormal blood pressure, chest discomfort, leg cramps, muscle strains, joint sprains or nausea, etc…

• The Client understands it is their obligation to immediately inform the trainer of any pain, discomfort, fatigue, or any other symptoms that they may be suffering from before, during, or after the session.

• The Client understands that they may stop or delay further training during the session and that the trainer may terminate the session upon observation of any symptoms of undue distress or abnormal response. Depending on the reason/motive of the delay or termination, the client may still be charged for the session. The decision to charge a Client for a session will be made at the discretion of the Trainer.


Pricing and Payment Terms & Conditions

• The Client agrees to automatic billing for 3 installments of 12 sessions.

• The Client acknowledges and agrees that this contract is not transferable or assignable.

• The Client acknowledges that payment is required for packages of sessions in advance of Proactive Training providing the service(s).

• The Client acknowledges that this specific contract, release of liability, consent, and agreement is continuously valid indefinitely.

• The Client understands that a minimum requirement of two sessions per week must be completed in order to receive free group training.

Cancellation & Lateness Policy

• All cancellations must be received at a minimum of 12 hours before your training session in order to avoid being charged for your session. Clients who do not cancel with 12 hours notice will be charged for the canceled session.

• Proactive Training understands that emergencies happen. We provide every client with one free short-notice cancellation. You will not be charged for your first cancellation with less than 12-hour notice. Subsequent short-notice cancellations will be charged for the session. The free short-notice cancellation only applies if Proactive Training is notified prior to the session start time. “No Show” Clients are not eligible for the one free cancellation.

• With regard to small group training packages (2 participants) clients unable to attend a scheduled session must alert the trainer and fellow group members of their absences at a minimum of 12 hours before the training session. Upon this notification the group training session will be canceled and rescheduled with no penalty to any of the package participants. Please refer to above for short-notice cancellation policies. If group training participates fail to comply with the 12-hour cancellation policy or is a “No Show” the group training session will continue and said group member will be charged for the missed session.

• Appointments will begin and end promptly as scheduled. Any delays to the start of a scheduled appointment at the fault of the client will not be a cause for extended service beyond the remainder of the scheduled time.


Package Expirations & Refunds

• The Client understands that packages and expiries will be put on hold for clients that notify the trainer of extended periods of leave e.g. vacations, illness, injury, family commitment, etc.

• The Client also agrees to notify the trainer of the estimated duration of absence from the training package.

• All packages expire 1 year to the date they are purchased. (no exceptions)

• The Client understands that money is not refundable for sessions already completed, or sessions canceled with less than 12-hour notice. (See our Cancellation & Lateness Policy below)

• The Client understands that no refunds will be granted for sessions not completed.
